This new legislation sets out smoke alarm requirements for all domestic dwellings that are leased or sold in Queensland. If you are a landlord, you will not be legally allowed to lease your property from 1 January 2022 unless it is compliant. (Tenants are under no legal obligation to ensure the smoke detectors are compliant.) These new legal requirements will apply to all residential properties in Queensland from 1 January 2027.

The new legal requirements for residential smoke alarms in Queensland are as follows:

  • All new smoke alarms must comply with Australian standards AS3786:2014.
  • This means that all new smoke alarms must be photoelectric.
  • In addition, all new smoke alarms must be interconnected.
  • Interconnected photoelectric smoke alarms must be installed in every bedroom, in every hallway that connects bedrooms, and be present on each level of the home. If there isn’t a bedroom on a particular level of the home, at least one smoke alarm must be installed on that level along the route that is most likely to be used to exit the home in an emergency.
  • All smoke alarms need to be tested every year, and replaced every 10 years.
